Welcome to Swadeshi Bhaarat. These Terms and Conditions ("Terms") govern your access to and use of our mobile application, website, and services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, accessing, or using the Swadeshi Bhaarat Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our Service.

2. Description of Service

Swadeshi Bhaarat is a business management platform that connects Business Development Directors, Channel Partners, Area Business Partners, Shop Owners, and Customers in a hierarchical network. The Service facilitates order management, promotional campaign participation, and business relationship management.

Note: The Service includes promotional campaigns, lucky draws, and competitions where customers can participate using promotional credits. These credits are not actual money and cannot be converted to cash or withdrawn.

3. User Accounts and Registration

3.1 Account Creation

• You must provide accurate, current, and complete information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account

3.2 Eligibility / Age Restriction

• User must be at least 18 years of age to use the Service
• Accounts must belong to an individual and not a company, corporation, or other entity

3.3 Account Types

• Business Development Directors (BDD): Can create and manage Channel Partners
• Channel Partners (CP): Can create and manage Area Business Partners
• Area Business Partners (ABP): Can create and manage Shops and Customers
• Shop Owners: Can process customer requests and view balances
• Customers: Can register orders and view their balances

4. Balance and Coupon System

4.1 Important Disclaimer – Not Actual Money

IMPORTANT: The account balance displayed in your Swadeshi Bhaarat account is NOT actual money. It represents promotional credits (PC) only. These credits have no monetary value and cannot be withdrawn, transferred, or converted to cash.

4.2 Customer Balance – Promotional Credits Only

• Customers receive promotional credits (PC) based on coupon value at signup
• Credits are used for campaigns, lucky draws, and competitions
• Credits are deducted only after shop owner approval
• Credits cannot be transferred, refunded, redeemed, or withdrawn
• Credits expire based on coupon terms
• Credits have no cash value

4.3 Coupons – Campaign Participation Credits

• Coupons provide promotional credits for participation
• Coupons may be used multiple times until credits are exhausted or expired
• Each customer can have only one active coupon at a time
• Coupons are subject to expiry and specific terms
• We reserve the right to invalidate coupons if misuse is detected

5. Orders and Transactions

5.1 Order Placement

• Orders are placed as part of campaign participation
• Sufficient promotional credits are required
• Orders are subject to shop owner/keeper approval
• Credits are deducted only upon approval
• Orders do not represent cash transactions

5.2 Order Status

• Pending: Awaiting approval
• Approved: Credits deducted
• Rejected: No deduction

5.3 Product Warranties

Swadeshi Bhaarat makes no implied or explicit warranties including merchantability, fitness for purpose, or non-infringement of products purchased. The Service is provided on an "as is" and "as available" basis. Usage of the website and app is entirely at the user's own risk.

6. User Conduct

• No illegal or unauthorized use
• No violation of laws
• No fake accounts or false information
• No malware, hacking, or system interference
• No sharing of account credentials

7. Intellectual Property

All Service content including text, graphics, logos, software, and designs are the exclusive property of Swadeshi Bhaarat.

8. Limitation of Liability

Swadeshi Bhaarat shall not be liable for indirect, incidental, consequential, or punitive damages arising from Service usage.

9. Indemnification

You agree to indemnify Swadeshi Bhaarat against all claims resulting from misuse or violation of these Terms.

10. Termination

We may suspend or terminate accounts at any time without notice for violations of these Terms.

11. Changes to Terms

Material changes will be notified at least 30 days in advance. Continued use indicates acceptance.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Jurisdiction shall lie exclusively with the courts of Pune, Maharashtra. This Service is intended for use only within India.

13. Severability

If any provision is held invalid, the remaining provisions remain in effect. These Terms must be read along with the Privacy Policy.

14. Force Majeure

We shall not be liable for delays or failures due to events beyond reasonable control including natural disasters, war, government actions, pandemics, cyber-attacks, or infrastructure failures.
